Mandated Employer Reporting

According to Maryland law, employers of health care professionals regulated by the Maryland Board of Physicians (the Board) are required to submit a report within 10 days. Certain actions are not reportable.

 Before You Begin

  • Are you a patient?  This is for employers of licensees to report personnel actions to the Board. If you are a patient and wish to file a complaint against a practitioner, please file an Online Complaint.

  • Are there any scenarios that don't require a report?  If you have additional questions about filing a mandated employer report, please visit the Board's website for Mandated Reporting Requirements FAQs.
    • Dr. Jane Doe and Hospital A mutually terminated Dr. Doe's employment contract. After the contract was terminated, Dr. Doe resigned her clinical privileges, which were in good standing.
    • Dr. John Doe voluntarily relinquished his clinical privileges at Hospital B and chose to focus on teaching and research activities.
    • The practice group that Dr. Jane Doe worked for did not renew its contract with Hospital C, which caused an automatic termination of Dr. Doe's clinical privileges at Hospital C.

  • What are the penalties for failing to file a report about an allied health professional with the Board?   An employer who fails to file a mandated report for an allied health professional is subject to a civil penalty of up to $5,000.00.  An employer found to make a report on an allied health professional in bad faith may be subject to a civil penalty of up to $5,000.00 (Health Occupations, §§ 14-5A-18, 14-5B-15, 14-5C-18, 14-5D-11.5, 14-5E-18, 14-5F-19, 14-5G-20, and 15-103).

  • What are the penalties for failing to file a report about a physician with the Board?   An employer who fails to file a mandated report for a physician is subject to a civil penalty of up to $10,000.00.  An employer found to make a report on a physician in bad faith may be subject to a civil penalty of up to $10,000.00 (Health Occupations, § 14-413, Annotated Code of Maryland).

Mandated Employer Reporting Information
The mandated reporting requirements have been updated. Some changes include, but are not limited to:
  1. Expanding the reporting requirements to all employers for all practitioner types--not just physicians;
  2. Establishing an exemption to reporting for all licensees who meet certain criteria and are in substance use disorder treatment;
  3. Standardizing the language regarding the reporting requirements for all licensees;
  4. Clarifying when a report is required, and what is required in the content of the report.

  • An employer tax identification number is required to file a mandated employer report. This information can be found on a W-2 or contact your human resources department. If you do not have an employer tax identification number, you may consider filing a Online Complaint instead.
  • You will have an opportunity to upload supporting documents (copies of emails, photos, etc.), so have these ready.
